BOOKING CONTRACT

Terms, conditions and obligations between SkiNorway Ltd and its customers

1. CONTRACT & CONFIRMATION

I. These terms and conditions and your confirmation invoice from SkiNorway Ltd form our contract. All persons listed on the confirmation invoice and on whose behalf a party leader maybe acting are subject to these terms and conditions.

II. Financial Protection – When you buy an ATOL (Air Travel Organisers Licensing) protected air holiday package from us you will receive a Confirmation Invoice from us confirming your arrangements and your protection under our Air Travel Organiser’s Licence number 9676. In the unlikely event of our insolvency, the CAA (Civil Aviation Authority) will ensure that you are not stranded abroad and will arrange to refund any money you have paid to us for an advance booking. III. A contract only exists between SkiNorway Ltd and you when a confirmation invoice has been issued. The date on the confirmation invoice will be the contract date. A quotation given by SkiNorway Ltd to you does not form a contract between us and in some circumstances prices can increase or decrease prior to the confirmation invoice being issued.

IV. In addition proof of purchase of flights including reference number and itinerary will be required. SkiNorway Ltd accepts this proof as deposit but reserves the right to take 20% of confirmation invoice as deposit or £180 per booking or the cost of flights for all passengers travelling at time of booking. Deposits are non refundable.

V. Any requests for additional services within 8 weeks prior to departure will be paid in full and not subject to a refund unless SkiNorway Ltd or its agents are unable to fulfil the requests.

VI. In the unlikely event of a confirmation invoice being issued with discrepancies we will reissue the confirmation invoice and we will not be bound by the price shown on the incorrect invoice. In such cases any monies owed to you will be paid in full immediately. Any monies outstanding to SkiNorway Ltd will be paid in full immediately.

VII. Assuming we are able to confirm your booking, we will send your confirmation invoice to you immediately. If you do not receive your invoice within 14 days you must contact us directly to make sure your booking is confirmed.

VIII. If we are unable to confirm your booking we will either offer you an alternative holiday at the current selling price or refund all monies paid to SkiNorway Ltd immediately. We must be notified within 7 days of the offer.  

2. PRICING

I. We guarantee that up until 30 days before your departure date the price of your holiday will not be subject to an increase in price except for:

(i) variations in transportation costs, including the cost of fuel;

(ii) variations in dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports; and

(iii) variations in exchange rates applied to the package

II. Your holiday will not be subject to any increase in prices in the period 30 days prior to your departure date.

III. Should the above mentioned price variations be downward then the price of your holiday will be accordingly reduced and any refund due paid to you.

IV. If the above price variations mean that the cost of your holiday goes up, we will absorb and you will not be charged for any increase equal to or up to 2% on your holiday price. You will only have to pay the amount over and above that 2% of the holiday price.

V. The price quoted on the final invoice will be guaranteed unless you change your booking.

VI. Final invoice price includes all currency surcharges, local taxes, VAT, UK and Overseas service charges.

VII. During the season it maybe necessary to purchase extra accommodation, transfers and services that may alter prices quoted in brochures or online. At time of booking you will be advised of such changes.

VIII. The prices quoted in this brochure or online are based on the rate of exchange 11 NKr

3. ALTERATIONS & CANCELLATIONS BY US

I. As holidays are booked in advance it is sometimes out of our control when changes are needed to be made to your holiday. We must therefore reserve the right to change holiday details after this contract has been entered into.

II. Any changes to your holiday will be advised as soon as it is possible to do so. Clause 2 will apply in relation to any changes in price applicable as a result of a change.

III. Where the change is a significant change, you will be offered alternative travel arrangements of equivalent or superior standard from us. If we offer you alternative travel arrangements of an inferior standard, this will be provided together with a refund of the difference in price. If you choose not to accept the offered alternative travel arrangements then you will be entitled to cancel your holiday with full refund.

IV. Significant change includes the following:

(a) an alteration to your scheduled time of departure or return of 12 hours or more;

(b) a change of UK depature airport (excluding change of London Airports);

(c) a change of hotel or apartment to a materially lower rating; or

(d) a significant change of resort area.

V. Any changes to self purchased flights will be your responsibility and you must advise SkiNorway Ltd immediately of any flight time, airline, or miscellaneous changes. Where transfers are arranged for specific flights an increase in transfer costs may apply.

VI. SkiNorway Ltd accepts no responsibility nor will we be liable for compensation for the following; war or threat of war, riots, civil unrest, terrorist activity, industrial disputes, natural disasters, epidemics, health risks, fire, technical problems to transport, closure or congestion of airports, stations or ports, cancellations or changes of schedules by carriers ceasing to operate due to adverse weather conditions or other reasons and similar events outside our control, or where we cancel because you have failed to pay the balance of your holiday cost.

4. CHANGES TO YOUR HOLIDAY IN RESORT

I. On rare occasions the accommodation we have reserved for you may not be available on your arrival owing to an occurrence out of our control and we may not have been notified in time to advise you before your departure. In such cases we will endeavour to provide you with accommodation of an equal or higher standard. In some circumstances it may be necessary to provide you with accommodation of a lower standard and you will receive a refund of the price difference between accommodations and £30 per person compensation. If we are unable to secure accommodation we will arrange to fly you back to your UK departure airport as soon as we reasonably can.

5. OUR LIABILITY

I. We accept responsibility for the acts and omissions of our employees, sub-contractors and local agents whilst acting in the course of their employment which are brought to our attention in resort and within 3 months of your return from holiday.

II. Although we do not control the day to day operation of our suppliers, we accept responsibility if is proved that facilities or services which form part of the holiday are deficient.

III. SkiNorway Ltd cannot accept responsibility or be held liable for death, bodily injury or illness caused on holiday unless it is proved that it is due to the actions or negligence of our employees, agents, suppliers or sub-contractors acting in the course of their employment. All cases must be reported in resort and within 3 months of your return from holiday.

IV. SkiNorway Ltd accepts no responsibility or nor can we be held liable for death, bodily injury, illness or loss of personal items prior to and during flights from the UK to resort or once you have checked in at resort airport returning to UK.

V. If you participate in winter sports whilst on holiday that have been arranged independently of SkiNorway Ltd, it should be understood that participation is at the individual's own risk and SkiNorway Ltd will not be held liable for any loss, damage, death or personal injury in relation to your participation in such activity.

6. BOOKING YOUR HOLIDAY & CONTRACT DETAILS

I. For details of deposit required see section 1.IV Contract & Confirmation.

II. Bookings will only be accepted if the lead name is 18 years or over.

III. It is the responsibility of all customers travelling to have adequate travel insurance. SkiNorway Ltd accepts no liability for customers travelling without adequate travel insurance.

IV. Receipt of our confirmation invoice is a declaration of you confirming your holiday details and accepting the terms of this contract on behalf of all persons listed on the booking.

7. PAYMENT

I. Payment must be received no later than 8 weeks prior to departure. The outstanding balance owed to SkiNorway Ltd will be shown on the final invoice issued approximately 10 weeks prior to departure. Any bookings made within 8 weeks of departure must be paid for in full at time of booking.

II. If payment is not made in full by the due date shown on the final invoice SkiNorway Ltd reserves the right to cancel your booking and any deposits paid will be non refundable.

III. If payment is made by credit card a handling fee per transaction will be levied at 2%. There are no handling fees for payments made by debit card or bank transfer.

IV. Failure to make payment of the outstanding balance will result in a cancellation charge being levied in accordance with the scale of charges set out in clause 10.

8. AMENDING YOUR BOOKING

I. If you wish to make amendments to your booking it will be possible to do so except if it is 14 days prior to departure.

II. Any changes and subsequent reissue of invoices will incur a £25 administration charge.

III. If changes to the total number of passengers travelling is less than on original confirmation invoice, supplements will apply and your final invoice will be recalculated to reflect the change.

IV. If you wish to add a passenger onto the booking this will be possible up to 14 days prior to departure and subject to our invoice reissue charge of £15.

V. Any amendments to your self purchased holiday flights are solely your responsibility and must be made directly to your chosen airline.

9. TRANSFERING YOUR BOOKING

I. It will be possible to transfer your booking to another date in circumstances that result from death, accident, illness, witness summons or redundancy to yourself, travelling companion or close relative. In such situations any changes and subsequent increase in cost to your holiday you must agree to pay the difference.

II. The company must be given reasonable notice of the transfer request. Reasonable notice is considered to be at least 14 days prior to the outward departure date.

III. Transfer is subject to you and the proposed transferee accepting joint and several liability for full payment of the package price and any additional costs arising in connection with the transfer.

10. CANCELLING YOUR BOOKING

I. If you cancel your holiday the lead name on the booking must contact SkiNorway Ltd in writing. Verbal cancellations will not be accepted. Cancellation notices must be sent to SkiNorway Ltd, 180 Piccadilly, London, W1J 9HF or by fax. 0207 917 6033

II. Cancellation charges will apply and are based on the total invoice value and are as follows;

56 days or more prior to departure - full refund less deposit

42-55 days - 60% of invoice charge

29-41 days - 70% of invoice charge

22-28 days - 80% of invoice charge

0 -21 days - 100% of invoice charge

Departure date/no show - 100% of invoice charge

III. If one member of the group wishes to cancel this may mean the accommodation is under occupied and the remainder of the group having to pay any supplements incurred.

IV. If you cancel your holiday on the day of departure due to circumstances out of our control compensations or refunds will not be payable by SkiNorway Ltd and any such claims should be forwarded to your travel insurance company

11. DURING YOUR HOLIDAY

I. Representation is offered from a central resort and assistance via a local 24 hour telephone number to an English speaking representative is available. Details will be provided either prior to departure from the UK or upon arrival at resort airport. Local agents/hoteliers are available to give guidance and assistance.

II. If you wish to make any changes whilst on holiday, for example, upgrade your accommodation, extend your holiday etc. Such requests may incur charges and are subject to availability. All charges are paid locally.

III. The accommodation booked is only available for those persons listed on the booking confirmation.

IV. You are responsible for any damages caused to your holiday accommodation except in circumstances out of yours or our control. Any damages to your holiday accommodation must be paid directly to the owner in resort.

V. You may also be required to pay a damages deposit on arrival in resort.

VI. Please remember that you are a guest at your holiday accommodation and any behaviour deemed disruptive or offensive that affects the enjoyment of other guests can result in you being asked to leave your holiday accommodation at your expense. This is at the discretion of the accommodation owner and SkiNorway Ltd representative.

12. PROBLEMS IN RESORT

I. Whilst we endeavour to resolve any issues in resort any problems in resort must be reported to a SkiNorway Ltd representative whilst on holiday and then in writing to SkiNorway Ltd within 3 months of your return from holiday.

13. SKINORWAY PRICES INCLUDE

I. Return air flights and transfers (coach, train, private taxi, hire car) to and from resort.

II. Flight baggage allowance - refer to airline terms of carriage for details.

III. Accommodation and meals as specified in your final invoice.

IV. All currency surcharges and local taxes, VAT, UK and Overseas service charges.

V. All current airport taxes are included.

14. SKINORWAY PRICES EXCLUDE

I. Meals and accommodation en-route.

II. In-flight catering en-route. (except where specified)

III. Ski travel insurance. (which you must have)

IV. Carriage of skis and snowboards on charter flights. (included on scheduled flights)

V. Porterage of luggage at any stage.

VI. Any services provided locally that are advertised as being available at the booked resort or accommodation, but not described as free of charge, e.g. child care, ski school, facilities.

VII. Credit card handling fees.

15. TRAVEL ARRANGEMENTS

I. All air travel arrangements included in your holiday operate under the airlines or holiday companies ATOL. See 1. III. in Contract & Confirmation. All air and travel arrangements. Airlines, aircraft types, timings, routings and arrival airports are provisional until confirmed with your tickets and may change after this due to circumstances beyond our control. We reserve the right to substitute airlines/aircraft and make any necessary alterations to your travel arrangements.

II. When you travel by air, land or on water, the relevant carrier’s ‘Conditions of Carriage’ will apply to your journey, some of which may limit liability, see Our Liability.

III. Operational decisions may be taken by carriers and/or airports, port authorities and other competent authorities, resulting in delays, diversions or re-scheduling. When such situations occur this is not within our control and we cannot accept liability for them.

IV. The baggage allowance shown on charter tickets excludes the carriage of skis and snowboards and must not exceed 20kilos. Skis and snowboard carriage will incur an extra charge of £19 per set of skis or single snowboard and must not exceed 6kilos in weight. Further charges will apply at time of check in if maximum weights are exceeded.

V. For baggage allowances for scheduled airlines please refer to your chosen airlines terms and conditions, any queries should be directed to the carrier.

VI. Personal property from the point of arrival to transfer vehicle and from transfer vehicle to accommodation and return remains the responsibility of the owner to ensure it is loaded/offloaded from the transfer vehicle. Porterage is not included.

VII. In the event of a flight delay SkiNorway Ltd accepts no liability or responsibility. SkiNorway Ltd will endeavour to assist where possible during extended delays.

VIII. Airlines do not offer compensation for inconvenience or loss of holiday time caused by flight delays. Similarly, it is not possible to obtain refunds for any unused accommodation or facilities in the event of an extended delay.

IX. Special requests can be made but it is not always possible to meet them, therefore they do not form part of this contract between you and SkiNorway Ltd.

16. RESORT TRANSFERS

I. Approximate timings given for resort transfers apply to the actual journey time after leaving the airport/train station. It maybe sometimes be necessary to combine, on certain transfers, customers arriving or departing on more than one flight or train and travelling to more than one resort, which may require additional waiting time at your airport, resort or stop off point. A change of coach or minibus may be required en-route.

II. We are sure you will appreciate that due to adverse weather, traffic delays or other factors beyond our control, timings may change.

III. Transfers are not accompanied by a representative.

IV. It may not always be possible for transfer coaches to reach your accommodation due to immediate circumstances, this will mean you may be required to walk the remaining distance and possibly carry your luggage.

V. Personal property remains your responsibility at all times except when under the direct control of ourselves or our suppliers.

17. VISA & PASSPORTS

I. It is your responsibility to be in possession of a valid, full 10 year passport and any necessary visas. From 5th October 1998 , under 16 year olds who are not already included on their parent’s passport are required to have their own individual passport.

18. THIS CONTRACT

I. This contract is governed by the law of England and Wales.

II. No employee or representative has the authority to orally vary these terms and conditions or enter into verbal agreements with customers of this company.
